In May, 2010, the Fun Time RV dealership, Cleburne, Texas, was closed
for business (as of this date they have not filed bankruptcy to our
If you are contacted by a customer who purchased a vehicle from Fun
Time RV and has been unable to obtain the title or MCO, please contact
Justin White with the Enforcement section of the TxDMV Motor Vehicle
Division. Justin has been in contact with the floor planners who are
providing him with the properly assigned ownership documents in most
situations.   Provide him with as much information as possible,
including the vehicle description (Make, Year and VIN), purchaser name,
contact information and whether a lienholder is involved.

Handling of customers in this situation was previously covered in a
listserv dated December 16, 2008, with the subject of "Dealer
Bankruptcy/Non-Bankruptcy Closures."  If the customer has one or more of
the following payment documents: Dealer Sales Contract,  Bill of Sale,
31-RTS Receipt, or Invoice, and these documents itemize tax, title and
license (TT&L) fees and indicate these fees have been paid, then all
registration and title fees and taxes should be waived for the customer
when processing the transaction.  If the amounts are not itemized, or
payment documents are not available, the transaction may be accepted
provided all other documents are available and all required fees, tax
and tax penalty collected.
For cash sales, due to the time lag between initial completion of the
paperwork and actual title filing, an additional affidavit of fact will
be required to support “no lien” title applications attesting there is
no lien on the vehicle at the time of title application.
Counties should submit transactions involving dealer closures to the
Title Control Section (TCS) in a separate envelope labeled DEALER
TAX - Questions about sales taxes should be directed to Curt Swenson,

TITLE - Questions concerning acceptable transfer documents should be
